210.536. 1. The cost of foster care shall be paid by thedivision of family services pursuant to chapter 207, RSMo, exceptthat the court shall evaluate the ability of parents to pay partor all of the cost for such care, and shall order such payment tothe department of social services.
2. The court may effectuate such order against any asset ofthe parent for failure to provide part or all of the cost offoster care according to the court order; provided further, thatany assignment, attachment, garnishment, or lien against suchassets shall be served upon the person in possession of theassets or shall be recorded in the office of the recorder ofdeeds in the county in which the parent resides or in which theasset is located. The department of social services may contracton a contingency fee basis with private attorneys for thecollection and enforcement of orders against such assets. Anysuch third party payment shall be paid directly to the departmentof social services.
