217.565. 1. The director in compliance with the provisionsof chapters 8 and 34, RSMo, shall purchase, lease, or otherwiseprovide suitable plants, machinery and equipment and purchasematerials to put the vocational enterprise programs into effect.The department may lease or purchase lands and buildings for theoperation and administration of the vocational enterprisesprogram.
2. The director may lease farm properties under thedepartment's control on terms and amounts which are fair andreasonable. All moneys received pursuant to this section shallbe deposited in the working capital revolving fund.
3. The department may purchase in accordance with chapter34, RSMo, such raw materials as may be required for any industryservice or agribusiness operation now or hereafter carried on bythe department and may employ such outside help as may benecessary.
4. The commissioner of administration may waive competitivebids and purchase required supplies for vocational enterprises onthe open market if they can be so purchased at a better price orfor delivery necessary to meet a current production requirementof vocational enterprises. The commissioner of administrationmay also purchase on the open market used equipment for themanufacturing, service, vocational training, or agribusinessoperations of vocational enterprises if the department directorcertifies that the purchase price of such equipment is equal toor lower than the current market value of such equipment.
5. The department shall be responsible for all articlesmanufactured, services provided, or products grown or processedby the vocational enterprises program, and shall act as adistributing agent for the manufacturing, service and productioncarried on in its correctional centers, with authority to appointagents or salespersons. The director shall be responsible forthe operation and maintenance of the factories, services,vocational training, and agribusiness and shall establish suchrules and regulations as are deemed necessary.
