Procurement process--notice--responsive bids, processing feeprohibited.

227.609. 1. The commission shall use a competitive procurementprocess to form a public-private partnership under sections 227.600 to227.669 and may proceed with a project under sections 227.600 to 227.669only if the commission issues a request for proposals for the financing,development, and/or operation of the project on the commission's owninitiative or in response to a request for approval submitted by apotential private partner under section 227.606.

2. The commission shall publish a public notice of the commission'srequest for proposals, including any deadline for submission of suchproposals. The notice shall be published once a week for two consecutiveweeks in:

(1) A newspaper of general circulation in the city where the proposedproject is located;

(2) At least one construction industry trade publication that isnationally distributed; and

(3) Such other publications or manner as the commission maydetermine.

3. The material and information required for submission by apotential private partner to be responsive to the commission's request forproposal shall be set forth in the proposal. Notwithstanding theprovisions of subsection 2 of section 227.606, the commission shall notcharge a processing and review fee.
