User fees.

227.639. The commission may impose user fees for the project. Thecomprehensive agreement shall provide the rate of such user fees as may beestablished by agreement of the commission and the private partner. Suchuser fees shall be set in an amount that takes into account any leasepayments, reasonable costs of financing, development, and/or operation. Arate schedule of the current user fees imposed and collected for use of theproject shall be made available by the private partner or the commission toany member of the public upon request. Such fees shall be the same forpersons using the project under similar conditions, except as required byagreement between the commission and the private partner to preservecapacity and prevent congestion on the project. The collection andenforcement of such user fees shall be consistent with sections 227.660 and227.666. The commission may authorize the private partner by thecomprehensive agreement to collect and enforce user fees for the project.
