Agreements authorizing private partner regarding procurement.

227.648. The commission may by agreement authorize or require aprivate partner to exercise any of the following provisions regardingprocurement for the financing, development, and/or operation of theproject:

(1) Use any project delivery method for the efficient developmentand/or operation of the project. Such project delivery methods shallinclude but are not limited to project delivery methods established insection 8.285, RSMo, or sections 227.100 and 227.107. In addition, thelimitation in subsection 1 of section 227.107 on the number of design-buildcontracts authorized to be let by the commission shall not apply to theproject;

(2) Make available to the commission, upon request, all procurementrecords for financing, development, and/or operation of the project;

(3) Exempt the project from the general procurement laws in chapter34, RSMo.
