233.010. 1. Territory not exceeding eight miles square, wherein islocated any city, town or village, may be organized as herein set forthinto a special road district; provided, however, the provisions of thissection shall not apply to counties under township organization or to classone counties except any first class county without a charter form ofgovernment which contains all or part of a city with a population greaterthan four hundred thousand and any first class county with a population ofover one hundred thousand inhabitants which does not adjoin another firstclass county and which contains a campus of the University of Missouri;however, any county of the second class which had within its boundaries,prior to January 1, 1989, a special road district already organized andexisting under this section and which second class county becomes a firstclass county without a charter form of government under the laws of thisstate, such change in classification shall in no way affect the existingstatus, nor the right to exist, nor the legality of the organization northe right to remain organized of any such prior existing special roaddistrict nor shall it in any way affect, alter or change the right of saidspecial road district so existing prior to the change in classification ofthe second class county to function and to lawfully continue to functionunder this section and section 233.165, in the same manner as such specialroad district functioned prior to the change in classification of thesecond class county. However, no city, town, or village containing morethan one hundred thousand inhabitants may be included within the territoryof a special road district organized under sections 233.010 to 233.165.
2. The eight square-mile territorial restriction provided for insubsection 1 of this section shall not apply to any special road districtorganized under the provisions of sections 233.010 to 233.165 within acounty of the fourth classification.
