Board's powers and duties--concurrent jurisdiction with specialroad subdistrict, when.

233.070. 1. The board shall:

(1) Except as provided in subsection 2 of this section,have sole, exclusive and entire control and jurisdiction overall public highways within its district outside the corporatelimits of any city or village therein, other than thosecontrolled by the highways and transportation commission, toconstruct, improve and repair such highways, and shall removeall obstructions from such highways, and for the discharge ofthese duties shall have all the power, rights and authorityconferred by general statutes upon road overseers;

(2) At all times keep the public roads under its charge inas good repair as the means at its command will permit, and forthis purpose may employ competent people at such compensation asthey shall agree upon, and may rent, lease or buy roadequipment, implements, tools and machinery, all kinds of motorpower, and all things needful to carry on such road work, or theboard may have such road work or any part of such work done bycontract, under such regulations as the board may prescribe; and

(3) Have authority to enter into contracts with any city,town or village within its district relating to the improvementof the streets, roads or highways, or any bridge thereon,located in the city, town or village.

2. Any special road subdistrict established under theprovisions of sections 233.500 to 233.520 shall have concurrentcontrol and jurisdiction over all public highways, bridges andculverts, other than those controlled by the highways andtransportation commission, within the boundaries of the specialroad subdistrict with any special road district containing landwithin the boundaries of the special road subdistrict. Thespecial road subdistrict may contract with the special roaddistrict to use the tools and machinery described in subsection1 of this section.
