233.240. If any such special tax bills be unpaid on thefirst day of February after becoming payable, the commissionersshall cause suits to be instituted for foreclosure of the lienthereof. Such suits shall be instituted in the circuit court ofthe county by any attorney the special road districtcommissioners may designate and order the county collector todeliver such unpaid special tax bills to. The road districtshall be plaintiff in such suits and any and all parties havingan interest in the property to be affected thereby may be madedefendants. In such suits, each special tax bill shall be primafacie evidence of a valid lien in favor of the district, and uponthe land described therein, for the amount stated therein. Inevery suit so instituted, there shall be taxed as costs, in favorof the attorney instituting the suit, a reasonable attorney'sfee, to be fixed by the court.
