Filing of reclamation report--appointment of commissioners.

242.240. 1. Within twenty days after the adoption of theplan of reclamation the secretary of the board of supervisorsshall prepare and transmit a certified copy thereof to thecircuit clerk of the court organizing the drainage district, andat the same time the board of supervisors shall file with thecircuit clerk a petition asking the judge of the court toappoint commissioners to appraise the lands within and withoutthe district to be acquired for rights-of-way, holding basinsand other drainage works of the district, and to assess benefitsand damages accruing to all lands in the district and otherproperty by reason of the execution of the plan of reclamation.

2. Within thirty days after the filing of such petition thecourt shall, by an order, appoint three commissioners, who shallbe persons residing within the state of Missouri, and who shallnot be landowners in the district nor of kin within the fourthdegree of consanguinity to any person owning land in thedistrict. A majority of the commissioners shall constitute aquorum and shall control the action of the board on allquestions.
