County commission's powers--treatment system, violations--complianceperiod--failure to comply, penalty.

249.515. 1. The county commission may contract with eachparticipating community for the payment of its proportionateshare of treatment costs.

2. The county commission may refuse to receive any wastesinto the sewage system which do not meet relevant waterpollution, solid waste, or pretreatment standards.

3. The county commission shall have all of the powersnecessary and convenient to provide for the operation,maintenance, administration, and regulation, including theadoption of rules and regulations, of any individual home orbusiness sewage treatment systems within the jurisdiction of thesewer district.

4. The county commission shall have power to pass allnecessary rules and regulations for the proper management andconduct of the business of the sewer district, and for carryinginto effect the objects for which the district is formed.

5. After the owner of the sewer treatment system has beennotified of any violation and has been given a reasonable time ofnot less than thirty days in which to come into compliance, itshall be a class C misdemeanor for any sewer treatment system tobe operated within the jurisdiction of the sewer district whichis not in compliance with applicable water pollution, solidwaste, or pretreatment regulations or ordinances. Any penaltyimposed by this subsection shall not preclude any appropriatecivil remedy.
