Federal law may preempt, when.

260.1092. 1. If federal law establishes a national program for thecollection and recycling of equipment and the department determines thatthe federal law substantially meets the purposes of sections 260.1050 to260.1101, the department may adopt an agency statement that interprets thefederal law as preemptive of sections 260.1050 to 260.1101.

2. Sections 260.1050 to 260.1101 shall expire on the date thedepartment issues a statement under this section.
