State employees acting in official capacity, liability.

260.540. Persons employed by the state of Missouri shallnot be held liable for damages incurred as a result of actionstaken by them when acting in their official capacity pursuant tosections 260.500 to 260.550, rules promulgated pursuant theretoand the hazardous substance emergency response plan. However,the state of Missouri may be held liable for any such damages asprovided in sections 537.600 and 537.610, RSMo, or as may becovered by liability insurance or a self-insurance plan.
