Operators of regional disposal facilities to purchase maximuminsurance--insurance to be used, how.

260.715. The operator of a regional disposal facilityshall purchase the maximum amount of commercially availablethird-party nuclear liability insurance, pay the necessaryperiodic premiums at all times, and make an annual payment tothe extended care and long-term liability account for suchamount as the department of natural resources reasonablydetermines is necessary. The department of natural resourcesmay make expenditures from this account, upon appropriation,for the purposes authorized in section 260.710. In the eventof expenditures from the account as a result of radioactivereleases from a regional disposal facility, the departmentshall to the maximum extent possible seek to obtain moneys fromsuch insurance prior to using moneys from the extended care andlong-term liability account.
