Discharge for testifying prohibited, civil action for damages,statute of limitations.

288.375. 1. No employer or employing unit shall discharge,discipline or penalize any employee because the employee hastestified on behalf of another employee in any proceeding underthis chapter.

2. Any employer or employing unit who violates theprovisions of this section shall be liable in a civil action forback pay lost by an employee as a result of the violation, and anemployee discharged or demoted in violation of this section shallbe entitled to be reinstated to his or her former or comparableposition. The burden of proof shall be on the party claiming aviolation to prove a claim under this section.

3. The statute of limitations for actions under thissection shall be six months from the date testimony was providedby the employee on behalf of another employee.
