Fraud or misrepresentation, penalties.

288.395. Any person or entity perpetrating a fraud ormisrepresentation under this chapter for which a penalty has not hereinbeen specifically provided shall be guilty of a class A misdemeanor and, inaddition, shall be liable to this state for a civil penalty not to exceedthe value of the fraud. Any person or entity who has previously pledguilty to or has been found guilty of perpetrating a fraud ormisrepresentation under this chapter and who subsequently violated any suchprovisions shall be guilty of a class D felony.
