301.3118. 1. Any member of Missouri Elks Association may receivespecial license plates as prescribed by this section, for any motor vehiclesuch person owns, either solely or jointly, other than an apportioned motorvehicle or a commercial motor vehicle licensed in excess of eighteenthousand pounds gross weight, after an annual payment of an emblem-useauthorization fee to Missouri Elks Association of which the person is amember. Missouri Elks Association hereby authorizes the use of itsofficial emblem to be affixed on multiyear personalized license plates asprovided in this section. Any contribution to Missouri Elks Associationderived from this section, except reasonable administrative costs, shall beused solely for the purposes of Missouri Elks Association. Any member ofMissouri Elks Association may annually apply for the use of the emblem.
2. Upon annual application and payment of a fifteen dollar emblem-usecontribution to Missouri Elks Association, the organization shall issue tothe vehicle owner, without further charge, an emblem-use authorizationstatement, which shall be presented by the owner to the department ofrevenue at the time of registration of a motor vehicle. Upon presentationof the annual statement, payment of a fifteen dollar fee in addition to theregistration fee and documents which may be required by law, the departmentof revenue shall issue to the vehicle owner a personalized license platewhich shall bear the emblem of Missouri Elks Association. Such licenseplates shall be made with fully reflective material with a common colorscheme and design, shall be clearly visible at night, and shall beaesthetically attractive, as prescribed by section 301.130.
3. A vehicle owner, who was previously issued a plate with theMissouri Elks Association emblem authorized by this section but who doesnot provide an emblem-use authorization statement at a subsequent time ofregistration, shall be issued a new plate which does not bear the MissouriElks Association emblem, as otherwise provided by law. The director ofrevenue shall make necessary rules and regulations for the administrationof this section, and shall design all necessary forms required by thissection. No rule or portion of a rule promulgated pursuant to theauthority of this section shall become effective unless it has beenpromulgated pursuant to the provisions of chapter 536, RSMo.
