301.3125. 1. Any vehicle owner may apply for "Be An Organ Donor"special personalized license plates for any motor vehicle the person owns,either solely or jointly, other than an apportioned motor vehicle or acommercial motor vehicle licensed in excess of eighteen thousand poundsgross weight. Upon making a twenty-five dollar annual contribution to theorgan donor program fund, established pursuant to section 194.297, RSMo,the vehicle owner may apply for the "Be An Organ Donor" plate. If thecontribution is made directly to the state treasurer, the state treasurershall issue the individual making the contribution a receipt, verifying thecontribution, that may be used to apply for the "Be An Organ Donor" licenseplate. If the contribution is made directly to the director of revenue,the director shall note the contribution and the owner may then apply forthe "Be An Organ Donor" plate. The applicant for such plate must pay afifteen dollar fee in addition to the regular registration fees and presentany other documentation required by law for each set of "Be An Organ Donor"plates issued pursuant to this section. Notwithstanding the provisions ofsection 301.144, no additional fee shall be charged for the personalizationof license plates issued pursuant to this section.
2. The "Be An Organ Donor" plate shall have the words "BE AN ORGANDONOR" in place of the words "SHOW-ME STATE". Such license plates shall bemade with fully reflective material with a common color scheme and design,shall be clearly visible at night, and shall be aesthetically attractive,as prescribed by section 301.130.
3. These plates shall be designed by the director, in consultationwith the organ donation advisory committee, established pursuant to section194.300, RSMo, to educate the public about the urgent need for organdonation and the life saving benefits of organ transplants.
4. A vehicle owner, who was previously issued a plate with the words"BE AN ORGAN DONOR" authorized by this section but who does not present acontribution receipt or make a contribution to the organ donor program fundat a subsequent time of registration, shall be issued a new plate whichdoes not bear the words "BE AN ORGAN DONOR", as otherwise provided by law.
5. The director of revenue may promulgate rules and regulations forthe administration of this section. Any rule or portion of a rule, as thatterm is defined in section 536.010, RSMo, that is created under theauthority delegated in this section shall become effective only if itcomplies with and is subject to all of the provisions of chapter 536, RSMo,and, if applicable, section 536.028, RSMo. This section and chapter 536,RSMo, are nonseverable and if any of the powers vested with the generalassembly pursuant to chapter 536, RSMo, to review, to delay the effectivedate, or to disapprove and annul a rule are subsequently heldunconstitutional, then the grant of rulemaking authority and any ruleproposed or adopted after August 28, 2004, shall be invalid and void.
