301.3147. 1. Any current undergraduate or alumnus member of anychapter of Theta Chi Fraternity may apply for special motor vehicle licenseplates for any vehicle such person owns, either solely or jointly, otherthan an apportioned motor vehicle or a commercial motor vehicle licensed inexcess of eighteen thousand pounds gross weight, after an annualcontribution of at least twenty-five dollars to the Foundation Chapter ofTheta Chi Fraternity, Inc. Theta Chi Fraternity, Inc., hereby authorizesthe use of their official emblem to be affixed on multiyear personalizedlicense plates as provided in this section. Any contribution to Theta ChiFraternity, Inc., derived from this section, except reasonableadministrative costs, shall be used solely for the purposes of thatorganization. Any undergraduate or alumnus member of Theta Chi Fraternity,Inc., may annually apply for the use of the organization's emblem.
2. Upon annual application and payment of twenty-five dollars to theFoundation Chapter of Theta Chi Fraternity, Inc., the organization shallissue to the vehicle owner, without further charge, an emblem-useauthorization statement, which shall be presented by the owner to thedepartment of revenue at the time of registration of a motor vehicle. Uponpresentation of the annual statement, payment of a fifteen dollar fee inaddition to the registration fee and documents which may be required bylaw, the department of revenue shall issue to the vehicle owner apersonalized license plate which shall bear the emblem of Theta ChiFraternity, Inc., and shall bear the words "THETA CHI FRATERNITY" in theplace of the words "SHOW-ME STATE". Such license plates shall be made withfully reflective material with a common color scheme and design, shall beclearly visible at night, and shall be aesthetically attractive, asprescribed by section 301.130. Notwithstanding the provisions of section301.144, no additional fee shall be charged for personalization of licenseplates pursuant to this section.
3. A vehicle owner, who was previously issued a plate with the ThetaChi Fraternity, Inc., emblem authorized by this section but who does notprovide an emblem-use authorization statement at a subsequent time ofregistration, shall be issued a new plate which does not bear the Theta ChiFraternity, Inc., emblem, as otherwise provided by law. The director ofrevenue shall make necessary rules and regulations for the administrationof this section, and shall design all necessary forms required by thissection. Any rule or portion of a rule, as that term is defined in section536.010, RSMo, that is created under the authority delegated in thissection shall become effective only if it complies with and is subject toall of the provisions of chapter 536, RSMo, and, if applicable, section536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and ifany of the powers vested with the general assembly pursuant to chapter 536,RSMo, to review, to delay the effective date, or to disapprove and annul arule are subsequently held unconstitutional, then the grant of rulemakingauthority and any rule proposed or adopted after August 28, 2004, shall beinvalid and void.
