Rules for vehicular traffic controlled by flashing signals--violation,penalty.

304.301. 1. Whenever an illuminated flashing red or yellow signal isused in a traffic sign or signal it shall require obedience by vehiculartraffic as follows:

(1) Flashing red (stop signal). When a red lens is illuminated withrapid intermittent flashes, drivers of vehicles shall stop at a clearlymarked stop line, but if none, before entering the crosswalk on the nearside of the intersection, or if none, then at the point nearest theintersecting roadway where the driver has a view of approaching traffic onthe intersecting roadway before entering the intersection, and the right toproceed shall be subject to the rules applicable after making a stop at astop sign;

(2) Flashing yellow (caution signal). When a yellow lens isilluminated with rapid intermittent flashes, drivers of vehicles mayproceed through the intersection or pass such signal only with caution.

2. Notwithstanding the provisions of section 304.361, any person whoviolates subdivision (1) of subsection 1 of this section is guilty of aclass C misdemeanor and any person who violates subdivision (2) ofsubsection 1 of this section is guilty of an infraction.
