Operate defined--probable cause required.

306.113. 1. For purposes of sections 306.111 to 306.119,the term "operate" means to physically control the movement of avessel in motion under mechanical or sail power in water.

2. No arrest shall be made under sections 306.111 to306.119 unless probable cause exists for that arrest.
