306.185. 1. There is hereby created in the state treasury the"Missouri State Water Patrol Fund", which shall consist of money collectedunder section 306.030. The state treasurer shall be custodian of the fundand shall approve disbursements from the fund in accordance with sections30.170 and 30.180, RSMo. Upon appropriation, money in the fund shall beused solely for the expenses of the Missouri state water patrol, includingbut not limited to personal expense, training expense, and equipmentexpense.
2. Notwithstanding the provisions of section 33.080, RSMo, any moneysremaining in the fund at the end of the biennium shall not revert to thecredit of the general revenue fund.
3. The state treasurer shall invest moneys in the fund in the samemanner as other funds are invested. Any interest and moneys earned on suchinvestments shall be credited to the fund.
4. Within available appropriations in this section, the commissionerof the water patrol shall establish with the advice of the director ofpersonnel an equitable pay plan for the members of the water patrol andradio personnel taking into consideration ranks and length of service.
5. If in the immediate previous fiscal year, the state's net generalrevenue did not increase by two percent or more, the state treasurer shalldeposit moneys, except for gifts, donations, or bequests, received underthis section beginning January first of the current fiscal year into thestate general revenue fund. Otherwise, the state treasurer shall depositsuch moneys in accordance with the provisions of this section.
