329.028. 1. There is hereby created in the state treasury a fund tobe known as the "Board of Cosmetology and Barber Examiners Fund", whichshall consist of all moneys collected by the board. All fees provided forin this chapter and chapter 328, RSMo, shall be payable to the director ofthe division of professional registration, who shall keep a record of theaccount showing the total payments received and shall immediatelythereafter transmit them to the department of revenue for deposit in thestate treasury to the credit of the board of cosmetology and barberexaminers fund. All the salaries and expenses for the operation of theboard shall be appropriated and paid from such fund.
2. The provisions of section 33.080, RSMo, to the contrarynotwithstanding, money in this fund shall not be transferred and placed tothe credit of general revenue until the amount in the fund at the end ofthe biennium exceeds two times the amount of the appropriation from theboard's funds for the preceding fiscal year or, if the board requires byrule license renewal less frequently than yearly, then three times theappropriation from the board's funds for the preceding fiscal year. Theamount, if any, in the fund which shall lapse is that amount in the fundwhich exceeds the appropriate multiple of the appropriations from theboard's funds for the preceding fiscal year.
3. Upon appointment by the governor and confirmation by the senate ofthe board, all moneys deposited in the board of barbers fund created insection 328.050, RSMo, and the state board of cosmetology fund created insection 329.240, shall be transferred to the board of cosmetology andbarber examiners fund created in subsection 1 of this section. The boardof barbers fund and the state board of cosmetology fund shall be abolishedwhen all moneys are transferred to the board of cosmetology and barberexaminers fund.
