Individuals and activities not limited by respiratory care practiceact.

334.900. So long as the person involved does not represent or holdhimself or herself out as a respiratory care practitioner as defined insubdivision (12) of subsection 2 of section 334.800, nothing in sections334.800 to 334.930 is intended to limit, preclude or otherwise interferewith:

(1) Self-care by a patient or gratuitous care by a friend or familymember;

(2) Respiratory care rendered, by any provider in the course ofemergency care;

(3) Persons in the military services or working in federal facilitiesfrom performing any activities as described in sections 334.800 to 334.930during the course of their assigned duties in the military service or afederal facility;

(4) Persons from engaging in cardiopulmonary research;

(5) Respiratory care rendered in the course of transporting a patientinto or out of the state of Missouri;

(6) The services rendered by state-certified aides, assistants ortechnicians as defined in the long-term care facility and licensure law; or

(7) The practice of respiratory care by:

(a) A licensed health care provider performing a respiratory careprocedure that is within the scope of practice of the licensee;

(b) A licensed health care provider performing a respiratory careprocedure that is not within the scope of practice of the licensee, so longas the licensee has received special training deemed sufficient by theboard for respiratory care;

(c) A health care provider who is not licensed but is certified orregistered, so long as the provider has received special training or passedan examination approved by the board for respiratory care;

(8) A person pursuing an accredited course of study leading to adegree or certificate in respiratory care at an accredited or approvededucational program so long as such person does not provide respiratorycare services outside the educational program. Such person shall bedesignated by a title that clearly indicates the person's status as astudent.
