Sale of poisons--regulations.

338.090. 1. It shall be unlawful for any person to retailany poisons enumerated in schedules "A" and "B", except asfollows: Schedule "A"--arsenic and its preparations, biniodideof mercury, cyanide of potassium, hydrocyanic acid, strychnia,and all other poisonous vegetable alkaloids and their salts, andthe essential oil of bitter almonds. Schedule "B"--opium and itspreparations, except paregoric and other preparations of opiumcontaining less than two grains to the ounce, aconite, belladonna, colchicum, conium, nux vomica, henbane, savin, ergot,cotton root, cantharides, creosote, veratrum, digitalis, andtheir pharmaceutical preparations, croton oil, chloroform,chloral hydrate, sulphate of zinc, corrosive sublimate, redprecipitate, white precipitate, mineral acids, carbolic acid,oxalic acid, without labeling the box, vessel or paper in whichthe said poison is contained, and also the outside wrapper orcover with the name of the article, the word "poison" and thename and place of business of the seller.

2. Nor shall it be lawful for any person to sell or deliverany poisons enumerated in schedules "A" and "B" unless, upon dueinquiry, it is found that the purchaser is aware of its poisonouscharacter and represents that it is to be used for legitimatepurposes. Nor shall it be lawful for any registered pharmaciststo sell any poisons included in schedule "A" without, beforedelivering the same to the purchaser, causing an entry to be madein a book kept for that purpose, stating the date of sale, nameand address of purchaser, the name of the poison sold, thepurpose for which it was represented by the purchaser to berequired and the name of the dispenser, such book to be alwaysopen for inspection by the proper authorities, and to bepreserved for at least five years.

3. The provisions of this section shall not apply to thedispensing of poison in not unusual quantities or doses upon theprescription of practitioners of medicine.
