Complaints against licensees, how made, hearing--sanctions--records.

346.100. 1. Any person wishing to make a complaint against alicensee under sections 346.010 to 346.250 shall reduce the same to writingand file the complaint with the board, setting forth the details thereofupon which the complaint is based. If the board, following aninvestigation, determines the charges made in the complaint are sufficientto warrant a hearing to determine whether the license issued under sections346.010 to 346.250 shall be suspended or revoked, the board shall file acomplaint with the administrative hearing commission as provided by chapter621, RSMo.

2. After the filing of such complaint, the proceedings shall beconducted in accordance with the provisions of chapter 621, RSMo. Upon afinding by the administrative hearing commission that the grounds, providedin subsection 2 of section 346.105, for disciplinary action are met, theboard may, singly or in combination, censure or place the person named inthe complaint on probation on such terms and conditions as the board deemsappropriate for a period not to exceed five years, or may suspend, for aperiod not to exceed three years, or revoke the license or certificate.

3. The board shall maintain an information file containing eachcomplaint filed with the board relating to a licensee. The board, at leastquarterly, shall notify the complainant and licensee of the complaint'sstatus until final disposition.
