Enrollment representative, defined--annual report to furnishinformation--solicitors of members to be insurance agent or broker,exception.

354.225. 1. Any employee of a corporation subject to theprovisions of sections 354.010 to 354.380 who, for compensation,solicits membership in a prepayment health services plan offeredby such corporation, or offers or assumes to act in negotiationthereof, shall be an "enrollment representative" of suchcorporation. Every corporation subject to sections 354.010 to354.380 shall furnish the director annually, at the time offiling its annual report, the name, title and address of suchperson employed by it as the corporation's enrollmentrepresentative.

2. Any person who, for compensation, solicits membership ina prepayment health services plan offered by a corporationsubject to the provisions of sections 354.010 to 354.380, who isnot an employee of such corporation, shall be an insurance agentor broker licensed to transact such business in the state ofMissouri.

3. Enrollment representatives, agents and brokerssoliciting, negotiating, procuring or making membershipagreements for a corporation subject to the provisions ofsections 354.010 to 354.380 shall be subject to all the insurancelaws of this state applicable to agents and brokers authorized tosolicit, negotiate, procure or make health insurance coverage inthis state, including those provisions of chapter 375, RSMo,relating to the education, licensing, appointment, terminationand discipline of agents and brokers.
