354.654. 1. The department of health and senior services shall issue aletter of designation as an essential community provider to any physician whomakes a written request and application to the department if such physicianmeets the qualifications of an essential community provider pursuant to theprovisions of section 354.652.
2. The department shall keep the names and addresses of all essentialcommunity providers on record and shall release such information upon request.
3. The department shall promulgate rules and regulations for theadministration of this section. Any rule or portion of a rule, as that termis defined in section 536.010, RSMo, that is promulgated under the authorityof this section, shall become effective only if the agency has fully compliedwith all of the requirements of chapter 536, RSMo, including but not limitedto, section 536.028, RSMo, if applicable, after August 28, 1998. Allrulemaking authority delegated prior to August 28, 1998, is of no force andeffect and repealed as of August 28, 1998, however nothing in this act* shallbe interpreted to repeal or affect the validity of any rule adopted andpromulgated prior to August 28, 1998. If the provisions of section 536.028,RSMo, apply, the provisions of this section are nonseverable and if any of thepowers vested with the general assembly pursuant to section 536.028, RSMo, toreview, to delay the effective date, or to disapprove and annul a rule orportion of a rule are held unconstitutional or invalid, the purported grant ofrulemaking authority and any rule so proposed and contained in the order ofrulemaking shall be invalid and void, except that nothing in this act* shallaffect the validity of any rule adopted and promulgated prior to August 28,1998.
