Prepaid dental plans, who may offer--certificate of authorityrequired--certain state laws not to apply.

354.702. 1. A prepaid dental plan may not be established oroperated in this state, nor may membership be solicited in such aplan unless the plan is offered by a prepaid dental plancorporation licensed under sections 354.700 to 354.723. Theprovisions of sections 354.700 to 354.723 shall not apply to aninsurance company, or health services corporation or healthmaintenance organization licensed to do business pursuant to thelaws of the state of Missouri.

2. By January 1, 1988, any person or other legal entity thatis operating a prepaid dental plan in this state must submit anapplication for a certificate of authority to the director. Eachsuch applicant may continue to operate until the director actsupon the application.

3. A prepaid dental plan corporation shall not be subject tothe laws of this state relating to insurance or insurancecompanies except as herein provided.
