Violations, penalties.

367.532. 1. Any title lender which fails, refuses or neglects tocomply with sections 367.500 to 367.533, sections 408.551 to 408.557, RSMo,sections 408.560 to 408.562, RSMo, or any laws relating to title loans orcommits any criminal act may have its license suspended or revoked by orderof the director after a hearing before said director on an order of thedirector to show cause why such order of suspension or revocation shouldnot be entered specifying the grounds therefor which shall be served on thetitle lender at least ten days prior to the hearing.

2. Whenever it shall appear to the director that any title lender isfailing, refusing or neglecting to make a good faith effort to comply withthe provisions of sections 367.500 to 367.533, or any laws relating toconsumer loans, the director may issue an order to cease and desist whichorder may be enforceable by a civil penalty of not more than one thousanddollars per day for each day that the neglect, failure or refusal shallcontinue. The penalty shall be assessed and collected by the director. Indetermining the amount of the penalty, the director shall take into accountthe appropriateness of the penalty with respect to the gravity of theviolation, the history of previous violations, and such other matters asjustice may require.
