Appeals.

369.319. An appeal shall be perfected by filing with thedirector of the division of finance within fifteen days afternotice of the director's decision is mailed, a notice of appealstating the name of the appealing party and the order or decisionappealed from. The director shall mail copies thereof to allinterested parties. Upon any such hearing the transcript of theproceedings before the director or, if the decision appealed fromwas made without a hearing, all writings used or considered bythe director in making such decision, shall be considered by thecommission and the commission may take evidence, the taking ofsuch evidence to be limited to newly discovered evidence in thoseappeals in which there was a hearing before the director and tobe governed by the provisions of chapter 536, RSMo. The reviewby the commission shall be similar to that provided in appeals inequity cases in the courts of this state. Decisions shall bemade as provided in chapter 536, RSMo. The costs on appeal shallinclude the per diem compensation of the members of thecommission and all such costs may be assessed against partiesother than the director as may be determined by the commission.At least fifteen days' notice of the hearing shall be given toall persons interested in the matter appealed from and to thedirector.
