Improper claims practice, conditions.

375.1005. It is an improper claims practice for anydomestic, foreign or alien insurer transacting business in thisstate to commit any of the acts defined in section 375.1007 if:

(1) It is committed in conscious disregard of sections375.1000 to 375.1018 or any rules promulgated under sections375.1000 to 375.1018; or

(2) It has been committed with such frequency to indicatea general business practice to engage in that type of conduct.
