Payments of premiums and claims deemed paid, when.

376.1080. If an insurer uses the services of anadministrator, the payment to the administrator of any premiumsor charges for insurance by or on behalf of the insured partyshall be deemed to have been received by the insurer, and thepayment of return premiums or claim payments forwarded by theinsurer to the administrator shall not be deemed to have beenpaid to the insured party or claimant until such payments arereceived by the insured party or claimant. Nothing in thissection limits any right of the insurer against the administratorresulting from the failure of the administrator to make paymentsto the insurer, insured parties or claimants.
