Delivery of guide and summary required, when.

376.706. 1. The insurer shall provide, to all prospectivepurchasers, a buyer's guide and a policy summary prior toaccepting the applicant's initial premium or premium deposit,unless the policy for which application is made contains anunconditional refund provision of at least ten days or unless thepolicy summary contains such an unconditional refund offer, inwhich event the buyer's guide and policy summary must bedelivered with the policy or prior to delivery of the policy.

2. The insurer shall provide a buyer's guide and a policysummary to any prospective purchaser upon request.

3. In the case of policies whose equivalent level deathbenefit does not exceed five thousand dollars, the requirementfor providing a policy summary will be satisfied by delivery of awritten statement containing the information described in section376.704(7), items (b), (c), (d), (e)b., (e)c., (f), (g), (j) and(k).
