Prohibition on kickbacks not applicable for rebates for certainchronic illnesses.

376.823. Section 191.905, RSMo, shall not apply to programsestablished by pharmaceutical companies for the purposes of providing apartial rebate of private health insurance co-payments and coinsurance topatients with multiple sclerosis or other chronic, potentially disabling,or life-threatening conditions who have been prescribed disease-managingmedicines for which there are no generic equivalents.
