Definitions.

376.854. As used in sections 376.850 to 376.890, the following termsmean:

(1) "Applicant":

(a) In the case of an individual Medicare supplement policy, the personwho seeks to contract for insurance benefits; and

(b) In the case of a group Medicare supplement policy, the proposedcertificate holder;

(2) "Certificate", any certificate delivered or issued for delivery inthis state under a group Medicare supplement policy;

(3) "Certificate form", the form on which the certificate is deliveredor issued for delivery by the issuer;

(4) "Director", the director of the department of insurance, financialinstitutions and professional registration;

(5) "Issuer" includes insurance companies, fraternal benefit societies,health care service plans, health maintenance organizations, and any otherentity delivering or issuing for delivery in this state Medicare supplementpolicies or certificates;

(6) "Medicare", the Health Insurance for the Aged Act, Title XVIII ofthe Social Security Amendments of 1965, as then constituted or later amended;

(7) "Medicare supplement policy", a group or individual policy ofinsurance or a subscriber contract, other than a policy issued pursuant to acontract under section 1876 of the federal Social Security Act, 42 U.S.C.section 1395, et seq., or an issued policy under a demonstration projectspecified in 42 U.S.C. section 1395ss(g)(1), which is advertised, marketed ordesigned primarily as a supplement to reimbursements under Medicare for thehospital, medical or surgical expenses of persons eligible for Medicare;

(8) "Policy form", the form on which the policy is delivered or issuedfor delivery by the issuer.
