Medicare supplement law applicable to what policies--policies notincluded.

376.859. 1. Except as otherwise specifically provided, sections376.850 to 376.890 shall apply to:

(1) All Medicare supplement policies delivered or issued for deliveryin this state on or after August 28, 1992; and

(2) All certificates issued under group Medicare supplement policies,when certificates have been delivered or issued for delivery in this state.

2. Medicare supplement policies do not include a policy of one ormore employers or labor organizations, or of the trustees of a fundestablished by one or more employers or labor organizations, or combinationthereof, for employees or former employees or a combination thereof or formembers or former members, or a combination thereof, of the labororganizations.

3. The provisions of sections 376.850 to 376.890 are not intended toprohibit or apply to insurance policies or health care benefit plans,including group conversion policies, provided to Medicare eligible personswhen policies are not marketed or held to be Medicare supplement policiesor benefit plans.
