381.045. 1. If the director determines that a person has engaged, isengaging, or has taken a substantial step toward engaging in an act,practice, omission or course of business constituting a violation in thischapter or a rule adopted or order issued pursuant thereto, or a person hasmaterially aided or is materially aiding an act, practice, omission, orcourse of business constituting a violation in this chapter or a ruleadopted or order issued pursuant thereto, the director may issue suchadministrative orders as authorized under section 374.046, RSMo. Thedirector may also suspend or revoke the license of a producer under section375.141, RSMo, or the certificate of authority of any title insurer asauthorized under section 374.047, RSMo, for any such willful violation.
2. If the director believes that a person has engaged, is engaging,or has taken a substantial step toward engaging in an act, practice,omission or course of business constituting a violation in this chapter ora rule adopted or order issued pursuant thereto, or that a person hasmaterially aided or is materially aiding an act, practice, omission, orcourse of business constituting a violation in this chapter or a ruleadopted or order issued pursuant thereto, the director may maintain a civilaction for relief authorized under section 374.048, RSMo.
3. Nothing contained in this section shall affect the right of thedirector to impose any other penalties provided for in the laws relating tothe business of insurance.
4. Nothing contained in this chapter is intended to or shall in anyother manner limit or restrict the rights of policyholders, claimants, andcreditors.
