Transportation prohibited until schedule of rates and fares is filedand published.

387.040. 1. No motor carrier subject to the provisions of thischapter shall engage or participate in the transportation of passengers orhousehold goods, between points within this state, until its schedules ofrates, fares and charges shall have been filed and published in accordancewith the provisions of this chapter. Any motor carrier, which shallundertake to perform any service or furnish any product or commodity unlessor until the rates, tolls, fares, charges, classifications and rules andregulations relating thereto, applicable to such service, product orcommodity, have been filed with the highways and transportation commissionand published in accordance with the provisions of this chapter, shall besubject to forfeiture to the state pursuant to the provisions of sections390.156 to 390.176, RSMo.

2. Notwithstanding subsection 1 of this section, a motor carriershall not be required to file its schedules of rates, fares, and chargesfor shipments of household goods that are transported wholly or exclusivelywithin a commercial zone as defined in 390.020, RSMo, or within acommercial zone established by the highways and transportation commissionpursuant to the provisions of subdivision (4) of section 390.041, RSMo.
