Penalty for violation of section 388.110.

388.120. If any person shall be elected to any office orappointed to any position in violation of section 388.110, andshall hold any such office or appointment, he shall forfeit andpay the sum of one hundred dollars for each and every day that heshall exercise the functions of said office, which amount may berecovered at the suit of any stockholder of the company in whichthe office or appointment shall be unlawfully held. Such suitshall be in the name of the company, and one-half of the amountreceived shall go into the treasury of the company, and the otherhalf to the stockholder prosecuting.
