Authorizing laying of underground water mains--power of eminentdomain.

393.020. It shall be lawful for any corporation organizedfor that purpose under chapter 351, RSMo, or heretofore organizedfor that purpose under any laws of this state, or any foreigncorporation for profit organized under or subject to chapter 351,RSMo, to lay and construct an underground water main, orunderground water mains, along the right-of-way of any publichighways in this state, or across any stream in this state, forthe purpose of furnishing, at wholesale only, a supply of waterto any incorporated city, town or village, or cities, towns andvillages, in this state; provided, that when it shall becomenecessary in laying and constructing such mains to make anyexcavations in any public highway, the company constructing suchmains shall restore such highway to as good condition as same wasin prior to the making of such excavations, and when necessary inlaying and constructing such underground water main or mainsevery such corporation shall have the power of eminent domain andmay condemn right-of-way for such underground water main or mainsin the manner prescribed by law for the condemnation ofrights-of-way of railroads; provided, that where such undergroundwater mains are laid along any right-of-way of any railroadcompany or through or under the roadbed of any railroad, thelaying of the same shall be according to standard and approvedrules of construction, and in such manner as not to weaken orimpair the same or the use thereof, but such construction shallbe according to such standards as will insure the safety of suchrailroads and the operation of trains over the same.
