Concerning the appropriation of property held by another corporation.

393.100. In case the property sought to be appropriated isheld by any corporation, the right to appropriate the same forthe purposes aforesaid by any corporation, company or individualshall be limited to such use as shall not materially interferewith the uses to which by law the corporation holding the same isauthorized to put said property. Where no agreement can be madebetween the parties, the mode of assessing the damages providedheretofore as to private persons shall be adopted, and if theproperty to be appropriated lies in more than one county, anapplication may be made in any one county in which any of thelands lie, and the damages shall be assessed as to all the landsof the defendant corporation along the whole line in oneproceeding.
