Incapacitation of beneficiaries, effect on powers and duties ofcustodian--immunities of third parties.

404.430. The incapacitation of a beneficiary who hastransferred property to a personal custodian does not terminatethe personal custodianship, directions given by the beneficiaryto the personal custodian, the designation of a successorpersonal custodian, any of the powers or authorities of thepersonal custodian or the immunities of third persons acting ondirections of the personal custodian. When a beneficiary becomesincapacitated, the personal custodian shall hold and administerthe custodial property in accordance with the provisions ofsections 404.400 to 404.650 applicable to incapacitatedbeneficiaries and the provisions of any written agreement betweenthe beneficiary and the personal custodian.
