404.835. 1. It shall be unlawful for a physician, nurse orother individual who is a health care provider or an employee ofa health care facility, hospital, nursing facility, residentialcare facility or other health care facility to require anindividual to execute a durable power of attorney for health careas a condition for the provision of health care services oradmission to a health care facility.
2. It shall be unlawful for an insurance company authorizedto transact health insurance business in this state, nonprofithealth care service plan, health maintenance organization, orother similar person or entity who contracts or agrees to theprovision of health care benefits to require an individual toexecute a durable power of attorney for health care as acondition to being insured or to receive benefits for health careservices.
