Violation of dealer agreement.

407.1340. Notwithstanding the terms of any RV manufacturer/dealeragreement, it shall be a violation of this chapter for:

(1) Any warrantor to fail to indemnify and hold harmless its dealeragainst any losses or damages, to the extent such losses or damages arecaused by the negligence or willful misconduct of the warrantor. Thedealer shall provide to the warrantor a copy of pending suits in whichallegations are made that come within this subsection within ten days ofreceiving such suit;

(2) Any dealer to fail to indemnify and hold harmless its warrantoragainst any losses or damages, to the extent such losses or damages arecaused by the negligence or willful misconduct of the dealer. Thewarrantor shall provide to the dealer a copy of pending suits in whichallegations are made that come within this subsection within ten days ofreceiving such suit.
