Subpoena issued under authority of grand jury, records, use of.

408.700. Financial records relating to a customer obtainedfrom a financial institution pursuant to a subpoena issued underthe authority of a grand jury:

(1) Shall be returned and actually presented to the grandjury;

(2) Shall be used only for the purpose of consideringwhether to issue an indictment or presentment by that grandjury, or of prosecuting a crime for which that indictment orpresentment is issued, or for a purpose authorized by theapplicable Missouri rules of criminal procedure;

(3) Shall be destroyed or returned to the financialinstitution if not used for one of the purposes specified insubdivision (2) of this section; and

(4) Shall not be maintained, or a description of thecontents of such records shall not be maintained by anygovernment authority other than in the sealed records of thegrand jury, unless such record has been used in the prosecutionof a crime for which the grand jury issued an indictment orpresentment or for a purpose authorized by rules 5 and 6 of theMissouri rules of criminal procedure.
