Commodity merchants--license required, boards of trade--designationrequired.

409.808. 1. No person shall engage in a trade or businessor otherwise act as a commodity merchant unless such person isregistered or temporarily licensed with the Commodity FuturesTrading Commission for each activity constituting such person asa commodity merchant and such registration or temporary licenseshall not have expired, nor been suspended nor revoked; or isexempt from such registration by virtue of the Commodity ExchangeAct or of a CFTC Rule.

2. No board of trade shall trade, or provide a place for thetrading of, any commodity contract or commodity option requiredto be traded on or subject to the rules of a contract marketdesignated by the Commodity Futures Trading Commission unlesssuch board of trade has been so designated for such commoditycontract or commodity option and such designation shall not havebeen vacated, nor suspended nor revoked.
