Fraud in sale of nursery stock--damages recoverable.

431.040. Any person, firm or corporation doing business inthis state as nurserymen or tree dealers, who shall falselyrepresent the grade or variety of any fruit trees, vines, shrubs,plants or bulbs which they sell, shall be guilty of amisdemeanor, and responsible for double the purchase price ofsuch fruit trees, vines, shrubs, plants or bulbs as damage, to berecovered by the purchaser of same.
