Subscribing witnesses, when and how summoned to prove execution ofinstrument.

442.330. Upon the application of any grantee in anyinstrument in writing required to be recorded or of any personclaiming under such grantee, verified by the oath of theapplicant, that any witness to such instrument residing in thecounty where such application is made refuses to appear andtestify touching the execution thereof, and that such instrumentcannot be proved without his evidence, any court or officerauthorized to take the acknowledgment or proof of such instrumentmay issue a subpoena requiring such witness to appear before suchcourt or officer and testify touching the execution thereof.
