Violations, procedures to forfeit the financial assurance instrument,attorney general to assist, when.

444.378. The attorney general, upon request of thedirector, shall institute proceedings to have the financialassurance instrument of the operator forfeited for violation bythe operator of any of the provisions of sections 444.352 to444.380. Before making such request of the attorney general,the director shall notify the operator in writing of the allegedviolation or noncompliance and shall afford the operator theright to appear before the director at a hearing to be held notless than thirty days after the consideration of the directorstatements, documents and other information with respect to thealleged violation. After the conclusion of the hearing, thedirector shall either withdraw the notice of violation or shallrequest the attorney general to institute proceedings to havethe financial assurance instrument of the operator forfeited asto the land involved.
