Monuments as boundaries.

448.2-114. The existing physical boundaries of a unit or thephysical boundaries of a unit reconstructed in substantialaccordance with the original plats and plans thereof, become theboundaries of such unit rather than the metes and boundsexpressed in the deed or plat or plan, regardless of settling orlateral movement of the building, or minor variance betweenboundaries shown on the plats or plans or in the deed and thoseof the building. This section does not relieve a unit owner ofliability in case of his willful misconduct, nor relieve adeclarant or any other person of liability for failure to adhereto the plats and plans.
